What you are missing is the state's evidence against you. If you watched this guy cross examine the cop's so called facts, one cop's testimony reads, 'I'm going to show you the breath test numbers are at zero, see? Now blow in the test tube.' Driver says, 'what's my number'? Cop never shows it to her. Now, here is the state making a case against you. You are told not to blow/walk/speak. All of a sudden the next move is the cop's evidence against you and you open your mouth and help him make a case against you. See it yet? Say you may have had a few, you are not technically drunk, but the state is going to generate income on your dime and says you were drunk without exposing that test result. And you see this as fair. They sort of took the 5th not showing you the result, right? Who is the corrupt one now breaking law?
And when you didn't catch the last part of the vid, where the lawyer shows him looking up at the imaginary cop and says nothing, absolutely nothing, where is the 'whatever you say can and will be used against you' now?... but you said nothing, being you have an out card the state is going to use to prosecute you with your own sober words.
Officer, did the defendant slur their words? Was the defendant leaning on a car? Was the defendant wobbly on their feet? No to all. Face red and flush? No. Bloodshot eyes? No. Was the person legally drunk using state's evidence against you without you saying a word? Yes or no?
What you are missing is how the state can be so inept on the test, criminally lie on the reports, if not; leaves out the eyes/face/wobble, but they sure have that test tool that is not technically accurate to use against you. You take the 5th because it protects your innocence you don't see. Say nothing, do not help build a case against you that will incriminate you. Can you put yourself in that scenario, because you know you are innocent during the stop, and some will do anything to generate that cash, yes or no the 5th helped you out on this one?
